USA: Garner family lead protest after reaching $5.9 million settlement with NY state

Eric Garner’s daughter led a rally in Staten Island on Monday night to mark a year since her father died in police custody after he was placed in a chokehold. Up to 40 protesters blocked traffic before rallying outside the Richmond County Courthouse, where criminal part of the New York Supreme Court sits. The protesters carried portraits of Garner and sang protest songs condemning the New York Police Department (NYPD) as racist. The protest comes on the same day as the state of New York reached a $5.9 million (€5.36 million) agreement with the Garner family. Scott Stringer, the city’s comptroller, announced the settlement but denied that the payment meant the city ‘had admitted liability’ for Garner’s death. The family had sought damages for ‘recklessness, negligence and carelessness’ of eight NYPD officers, the city and the NYPD as a whole. Eric Garner died July 17 2014 after New York Police Department (NYPD) Officer Daniel Pantaleo put him in a chokehold as multiple NYPD officers tried to detain him on charges of selling loose cigarettes. A grand jury decided not to indict Pantaleo on December 3. Mobile phone footage of the incident showed Garner, who was asthmatic, complaining repeatedly “I can’t breathe.” Since Garner’s death New York has begun a pilot programme to start equipping their officers with body cameras to record their conduct whilst on duty.
