The International Court of Justice (ICJ) ruled in favour of India and ordered Pakistan to review the case of alleged Indian spy Kulbhushan Jadhav, at a hearing in The Hague on Wednesday.
By 15 votes in favour to 1 against, the ICJ approved the Republic of India’s bid to keep Jadhav from death row, declaring that Pakistan had violated Jadhav’s rights in a number of aspects.
President of the ICJ, Abdulqawi Ahmed Yusuf, said that Pakistan had deprived India “of the right to render the assistance provided for by the Vienna Convention to the individual concerned” and “of the right to communicate with and have access, to visit him in detention and to arrange for his legal representation."
Pakistan is therefore obliged to “provide, by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Mr. Kulbhushan Sudhir Jadhav,” added the ICJ president.
The judgment is final, binding and without appeal; however the ICJ does not have the means to enforce its rulings.
Jadhav, an Indian Navy officer, was arrested in Pakistan in 2016 under accusations of espionage and sabotage. He was sentenced to death in 2017 by a Pakistani military tribunal. India denied all the charges and accused Pakistan of violating Jadhav’s rights, appealing to the International Court of Justice for his release.
